 I know you folks may have made a few CD's to play the song in your trucks etc. I think that may be ok to play the song out loud., but make sure that you put the name on all of those CD's  of the song and the name of the songwriters. An my e-mail and phone number. You can do it with a black sharp marker. If any end up at a radio stations by accident :) They may be able to play it if they have the contact info. Put BMI by my name an ASCAP by David Ayers. Make sure you do this on any you may have and tell others to do the same. This way if they play it, I think they have to pay. It's better to use a CD label but you don't have to do that.

Wednesday, April 23, 2008 – Diesel users pay 6 cents more per gallon than gasoline users in federal taxes at the pump. That could all change if a bill introduced in the Senate is passed into law.

Sen. Olympia Snowe, R-ME, introduced the “Diesel Tax Parity Act,” on Monday, April 21. The bill seeks to drop the federal diesel tax to 18.3 cents per gallon through the end of 2008.

Currently, 24.3 cents on the gallon are collected in federal fuel taxes on diesel.

Diesel prices have reached record after record and are now averaging nearly $1.30 a gallon more than this time last year.

“The dramatic rise in fuel costs has resulted in lobstermen and truckers (going) out of business – thereby endangering Maine’s most prosperous industries,” Snowe stated in a press release on the bill’s introduction. “One way to immediately alleviate this burden is to lower the diesel tax to make it proportional and equal to the gas tax.”

The bill outlines the procedures for implementing and rescinding the fuel tax reduction, with the rebates and credits being handled at the distributor level.

Truckers and other diesel users will get the 6 cents per gallon federal tax break at the pump with no paperwork hassle.

“Our trucking industry and small businesses are in a crisis and drastic steps need to be undertaken by Congress. The situation for Maine’s trucking industry is simply untenable and we need immediate action to lower the price of fuel for small businesses that are impacted by these historic costs,” Snowe said in the press release.

The bill has been assigned to the Senate Committee on Finance.
<<b>b>SPECIAL REPORT:# 2Trucking industry takes big hit in first quarter

Tuesday, April 22, 2008 – Trucking companies going out of business in the first quarter of this year rivaled the record levels of failures reported in 2000 and 2001, according to a report released by Avondale Partners LLC.

The report, written by longtime trucking analyst Donald Broughton, reported that an estimated 42,000 trucks, or 2.1 percent of the nation’s over-the-road, heavy-duty truck capacity went out of business in the first three months of 2008.

Broughton laid blame at the feet of continued pressure from all cost fronts, which include the “inability of fuel surcharges to keep up with constantly rising fuel costs” and forking out more cash for renewing licensing and insurance that typically come due at the first of the year.

These pressures, according to Broughton, pushed companies that were “teetering on failure, over the edge.” He reported that the majority of companies failing were smaller companies with longer lengths of haul.

The end result was 935 companies that went out of business – a number that surprised even Broughton. In terms of this report, Broughton’s data generally counts only trucking companies with five or more trucks.

In his report, he looks back on 2000 and 2001, another historically tough time in the trucking industry, and compares it to the current conditions truckers face.

He pointed out that a “segment” of shippers and freight brokers took a long hard look at pricing in the first quarter. Some went so far as to refuse to pay any fuel surcharge or, “in the case of brokers, collected it and then failed to pass it on.” There was an even larger group of shippers who resisted rates and surcharges being charged by carriers.

“Many carriers were desperate enough to find loads that they forgot the lessons learned in 2000 and carried freight without collecting a fuel surcharge,” Broughton wrote.

Broughton takes a long hard look at what is wrong with the fuel surcharge system in its current form in his report.

Even in the best of times, he points out, because of idling, out-of-route miles run while looking for a place to park or to avoid congestion, and deadheading miles, even the best fuel surcharge programs recoup only about 85 percent of the additional cost – at the most.

The current fuel situation is causing more problems with the fuel surcharge system, Broughton reports.

He explained that most companies set a surcharge for the week based on the U.S. Energy Information Administration’s weekly averages. But, because of that, most carriers don’t have a system in place to adjust their surcharge for fuel prices on Tuesday that are higher than they were on Monday and so on throughout the week.

Most bills of lading are paid on 45-day terms. Even if 100 percent of fuel costs incurred at the time of the load were paid – which Broughton pointed out is not the case – the expense created by the rising cost of fuel while waiting on payment forces truckers to need more cash on hand to meet that ever increasing expense.

The glimmer of hope offered in Broughton’s report was more of a history lesson. As tough as things were in 2000 and 2001, truckers who were in business following the downturn “experienced the strongest pricing power since the industry” was deregulated in 1980

The California Air Resources Board performed idling inspections on nearly two-thirds fewer commercial vehicles and buses in 2007 than the agency did in 2006. The agency did, however, set a new record for penalties, with three major corporate settlements bringing total penalties collected to $29 million.

In 2006, CARB inspected 4,300 commercial vehicles and school buses for idling violations. That figure dropped to 1,580 for 2007. Three major settlements are credited with pushing the total fines collected to a record amount: Sierra Pacific Industries, Yamaha Motor Corp. and the Evergreen Pulp Mill tallied $21 million in assessed penalties.

The total the agency collected in 2007 was $29 million. In 2006, CARB collected $6 million in fines and total penalties.

Total violations across the board for truck, motorcycle, fuel, locomotive and other categories increased from 1,992 citations in 2006 to 3,442 citations in 2007.

Inspection statistics for pollution sources showed that the environmental agency keyed on heavy duty trucks. In 2007 CARB inspected:

* 20,000 heavy duty vehicles;
* 1,500 commercial vehicles and school buses;
* 1,900 locomotives;
* 1,900 cargo tanks;
* 2,500 consumer products;
* 1,900 trash trucks; and
* 9,900 heavy duty diesel vehicles in low-income communities.

CARB Chairman Mary Nichols said the agency’s enforcement officers will continue to catch and fine businesses who avoid meeting pollution control obligations.

“With an estimated 93 percent of our population still living in areas that fail to meet federal health standards, we must continue to do all that we can to ensure our factories, vehicles, engines and consumer products meet our stringent requirements,” Nichols said.

I don't know what all the political beliefs are out there, but I think this is one bandwagon I wanna' get on and quick!

Illinois lawmaker pursues summer sales tax holiday for fuel
If an Illinois state lawmaker gets his way, truckers and other drivers would get a four-month tax break at the fuel pump.Rep. Bill Black, R-Danville, introduced a bill that would offer a sales tax holiday on motor fuels sold in the state between May 1, 2008, and Sept. 15, 2008. The state made a similar cut in 2000, but it lasted for six months.

I just thought since of the high fuel price and everything that is not going right for us truckers, I would like to report a broker that is not being fair to anyone. 
Today, I took a load from White Sand Missle Range,NM to Avon,OH.  It was to be 2 pieces, one 11' and one 18'.  I took this load with all intentions that I would have room left to throw something else on.  This load was paying $2800.  My driver arrived on the base to load and mentioned to the military personnel, that he thought the military payed atleast some type of fuel surcharge.  The gentlemen then showed my driver the bill that "US TRANSPORT", out of Brookwood, AL, had charged them.  The breakdown consisted of fuel and permits and the grand total payed to US Transport was over $6300.00.  My driver was there to pick up a legal load.  I called the broker back and she knew it was wide and they offered me $200 extra to pay for permits.  I said no thanks,  I will take $6000 since you are getting $6300.  They did not like that I found out they were making over $3000 on the load.  I then asked for truck order not used.  I was told I would not receive it since I refused to load the load.

From that time on we will no longer accept any loads at ANY price untill such time as our FED Gov admits & puts into action a plan that will give all O/Os some help.
Here is what I would like to see happen,
1# suspend ALL Fed & State fuel taxes untill such time that this economy is back on its feet
2# Feds create a FED Oversite Committee to oversee Ins Prieums Charged for Class 8 trucks Insurance
3# Stop allowing Large Trucking Fleets to self Insure, this would make a more level playing field for all trucking Cos
4# Fed Regs for Brokers & Shippers that are inforced, with set  max amounts they can charge.
5# Standerized Fines from Coast to Coast for safety violations. in other words if a log ticket cost $50.oo in Missouri then a log ticket in Calif should only cost $50.oo

called me tonight and stated that they are indeed supporting the April shutdown, They have comitted 16,000 trucks will shut down to show support for our Message To Washington D.C.
Now if you figure that each truck runs 500 miles a day & gets 6 miles to the gallon, thats 83.33 gallons of fuel per truck. now figure that at say $3.80 a gallon & thats low that comes out to $316.65 worth of fuel not bought that day per truck x 16,000 trucks = $5066400.oo
And that figure is just that 1 union , that does not include the owner / operators that are shuting down for april 1st, 2008
I wonder if all total Washington, DC will notice ??

Schneider National Statement on Rumored Trucking Shutdown

The rapid run-up on fuel is difficult for all of us: Drivers, carriers,
shippers and consumers are all feeling the pinch with no immediate
relief or solution in sight.

It's business as usual at Schneider National, for both our company
drivers and the owner-operators (independent contractors) with whom we
contract hire to haul freight. Contrary to online reports, we are not
participating or endorsing the rumored trucking shutdown. We will
continue to dispatch loads to meet customer demand and fully expect our
drivers to meet their professional obligations.

There are approximately 3.4 million truck drivers in the U.S. Of those,

Program offers significant fuel price protection. Even when a
contractor purchases fuel at $4 per gallon            average, the net
effect of the FSC program results in an actual net fuel cost per gallon
of
well less than $1.90 per gallon     even if the unit only averages 5
MPG.
At 6 MPG the net effect is less than $1.50 per gallon.
*     We use our combined buying power to obtain the best deals we can
get
from fuel suppliers and pass the entire discount      on to the
independent
contractor
*     We offer fuel at our Operating Centers at some of the lowest
prices
available. These prices are updated daily on our            Crossroads
Web
site.
*     We make available to independent contractors our industry-leading
expertise on driving tips and fuel-efficient equipment
specifications
like aerodynamic tractors, fuel-efficient tires and devices to keep the
truck warm without idling.  We have       programs that allow
independent
contractors to buy these components at very competitive prices.

We've seen these types of events before. They are rarely successful and
in the end, drivers who participate hurt their own livelihood more than
the companies, the industry, the government or the consumers to whom
they're trying to send a message.

There is an excess of drivers in the market to support current freight
demands. Drivers who choose to participate in a trucking shutdown like
this will unfortunately be quickly replaced by another company or
independent driver--an unintended consequence of this effort and
something none of us wants to see.

Our message to our drivers is:
*     Conserve fuel
*     Shutdowns don't solve problems
*     Customers must be served
*     Safety will be handled
*     Keep working

Congrat's on your idea of showing them. I am a farmer in NC, running for Governor, fed up taxpayer, and will put my common sense plans against any other candidate in the state or the USA. Never held any elected office before.

With this word slowly getting out, change really is coming. If you/truckers are ever in NC, please fill up with our diesel if I'm elected. We will have the cheapest fuel in America. Keeping billions in corporate profits in our state replacing taxes.

Fuel protests planned across the country as frustrations rise

As diesel continues to cost in the neighborhood of $4 per gallon, truckers are making their frustration known in state capitals and across the country.

On Monday, March 31, truckers in Pennsylvania drove bobtail tractors to the Capitol in Harrisburg to raise awareness about the fuel crisis.

On Tuesday, April 1, cattle hauler Dan Little of Carrollton, MO, will find out how many drivers are answering his call for a nationwide shutdown.

Also on Tuesday, about 250 drivers in Georgia plan to form a convoy from Macon to Atlanta, according to media reports. The Georgia truckers include log hauler Sheila Walker, who was quoted in a New York Times article as having said that the shutdown in her state would last at least three days.

“I’ve got plenty of backbone, and I’m not scared. I’m not backing down,” Walker told the New York Times. “I can’t make my living when fuel prices have doubled since 2006 but the pay at the mills has not gone up.”

Walker has been running Walker Trucking since her husband died of a heart attack in 2004. She said that three of her paychecks in recent months were less than her fuel bills during those periods.

The same New York Times report that quoted Walker also included information from the Owner-Operator Independent Drivers Association.

“Every 5-cent increase in fuel prices increases a trucker’s annual expenses by about $1,000, according to the Owner-Operator Independent Drivers Association, which (has) asked Congress to help drivers collect more fuel surcharges,” stated the New York Times news story.

Getting that kind of information out to mainstream media, the general public and lawmakers is something that staff at OOIDA have been working on for weeks.

In addition to raising public awareness about the difficulties truckers currently face, OOIDA leaders and staff are also fielding dozens of media inquiries every day about whether drivers will strike. The media also want to know what impact a strike would have on the price of diesel and the prices of the products that are delivered by trucks, which are fueled with that diesel.

“We are repeatedly asked by the media if a strike will have an impact and so we remind them that it’s not just about one day, or one week; it’s about the longer term if diesel prices do not change. Truckers are consumers, too,” said Norita Taylor, OOIDA media spokesperson.

OOIDA leaders say that while the Association cannot legally support a strike, it can and does support individual truckers. The Association also encourages individual truckers to contact their lawmakers now about the fuel situation.

“We do not tell our members what to do; instead, they inform us of what they ARE doing and we support their decisions,” said Todd Spencer, OOIDA executive vice president.

Spencer said that truckers need to make it known to their elected officials that they are being exploited in the current fuel situation and that action needs to be taken to change the industry.

“Lawmakers need to know what’s going on in trucking, how devastating this record hike in fuel prices is for 90 percent of the nation’s fleet,” added Spencer.

“There is a disproportionate burden being placed on small-business owners who are truck drivers because they depend upon diesel to run their businesses. If diesel is the lifeblood of ground transportation, then truckers are the heart. And many are in need of life support.”

OOIDA would like Congress to enact legislation mandating 100 percent pass-through of fuel surcharges and full transparency in those transactions.

Just wanted ya'll to know that we here in NC are in full support and commend you for stepping up.  I've been a co. driver and o/o for over 35 yrs and am still waiting for it to get better. The co I work for now shut down last week and we plan to stay out as long as it takes.  We haul frozen and other perishables almost nationwide.  I think

if we stay out long enough for the people to start looking for something to but we may do some real good for our industry.  I'd sur enough be at your meeting if possible but without working it would be rough.

With sporadic trucker protests continuing across the country, legislators appear to be listening. The Vermont state senate directed the Attorney General to conduct "an aggressive" criminal investigation of major oil companies, charging possible price-fixing and consumer fraud.

"At the same time that we are paying $3 and $4 a gallon for gas and oil, the oil companies are making record profits, billions and billions of dollars," Senator Peter Shumlin told the Associated Press. "It's puzzling to us that so few politicians both on a state and national level are saying enough is enough."
